If you or a family member have been arrested for DUI in Northeastern Pennsylvania, contact Attorney Frank J. Bolock, Jr., in order to receive a free legal consultation.

With over 35 years of legal experience Attorney Bolock can help you prepare your defense, assisting, minimizing or eliminating the charges against you.  In many cases Attorney Bolock can position your case for disposition under the Pennsylvania Accelerated Rehabilitative Disposition Program (ARD).  If your case can be positioned for treatment under the ARD Program there is no jail time and the sentence usually consists of probation and community service.  When an ARD case is completed the DUI charges are dismissed a Defendant’s criminal record may be permanently expunged.

In the Commonwealth of Pennsylvania the severity of a DUI charge depends on how much alcohol is determined to be in the blood stream of a driver according to a ratio called the Blood Alcohol Concentration (BAC).  The higher a person’s BAC, the higher the penalties potentially imposed by the Court.

The Commonwealth of Pennsylvania has established three tiers of driver impairment based on the BAC.

Criteria

  • BAC between .08 and .099%
  • No property damage or injury
  • Driver is at least 21 years of age

  • General BAC with an accident or injury
  • General BAC if driver is under 21
  • School Bus Driver with BAC between .02% and  0.159%
  • Commercial Vehicle with BAC between .04 and 0.159%
